Article 1: Organization

The company [scrape]® – CORPOMARKET, hereinafter referred to as "The Organizer", whose registered office is located at 17 RUE DE ROSHEIM 67000 in STRASBOURG, registered under RCS STRASBOURG A 832 707 160, is organizing a game with purchase obligation from 24/11/2022 to 24/12/2022 midnight (inclusive). The stock of products available for sale is limited to 500 units, so the game may end before the indicated date if stocks run out.

Article 2: Participants

This game with purchase obligation is open to adults, regardless of their place of residence, provided they have first obtained express authorization from their parents or the person exercising parental authority. Their participation implies that they have obtained this authorization.

Excluded from the game are persons not meeting the above conditions, as well as staff members of "The Organizer", and any person who has directly or indirectly participated in the design, execution or management of the game, as well as their spouses, members of their families: direct ascendants and descendants or other relatives living or not under their roof.

"The Organizer" reserves the right to ask any participant to justify the conditions set out above. Any person who does not meet these conditions or refuses to justify them will be excluded from the game and, in the event of a win, will not be able to benefit from their prize.

Participation in the game implies full acceptance of these rules.

To participate, the player must purchase the new [scrape]® Balaclava, hereinafter referred to as the "product concerned", within the time limit defined in Article 1 of these rules. The number of participations is unlimited; each product purchased includes a numbered ticket that will serve as a reference during the draw. The same order can contain several of these products and therefore several chances of being drawn.

The participant must fully and correctly meet the various conditions set out in these rules to validate their participation. The player is informed and accepts that the information entered during the purchase of the product will serve as proof of their identity.

Any participation carried out contrary to the provisions of these rules will invalidate the participation. Any participant suspected of fraud may be excluded from the contest by "The Organizer" without the latter having to justify it, and may also lead to legal proceedings. Any incomplete, erroneous, or illegible identification or participation, whether voluntary or not, or carried out in a form other than that provided for in these rules, will be considered null and void.

Article 4: Prize

For any purchase of the product concerned, the player is offered the possibility of winning a YAMAHA PW 50 model 2023 two-wheeled motor vehicle worth €2099 (incl. tax) or the equivalent of this sum in euros, paid by bank cheque to be cashed within one year of its issue. For foreign players, this sum will be paid by transfer in their country's currency and according to the current exchange rate. Bank transfer fees will be deducted from the €2099 prize money.

The winner is free to choose their prize, but cannot retract their decision once it has been made and communicated by email to contact@just-scrape-it.com, an email that will be acknowledged by the organizers.

The deadline for collecting prizes is two weeks from the day the result is announced. If the winner does not collect their prize, it will be put back into play and redrawn by Maître Ségolène LE BLAYE under the same terms.

The value of the prize is determined at the time of drafting these rules and cannot be contested as to its valuation, participants accepting, by their participation, the prizes offered.

All costs incurred after the game, particularly for the maintenance and use of this prize, are entirely the responsibility of the winner.

The Organizer cannot be held responsible for the use or non-use, or even the trading, or loss of the prize by the winner.

Article 5: Winner Selection

The draw will take place within seven (7) days following the end of the Contest and will be announced via a publication on the page dedicated to the contest.

It will result in the drawing of a single winner.

The draw will be conducted by Ségolène LE BLAYE, Attorney at Law at her office, located at 33 rue du Faubourg Poissonnière, Paris 9e, France.

Article 6: Winner Announcement

The winner drawn by Maître Ségolène LE BLAYE will be notified within 72 hours directly via the contact details they provided when placing the order. If the winner fails to respond within seven calendar days from the date of the prize notification sent by the organizer, they will be deemed to have simply renounced it. The participant will then forfeit their right, and the prize will become the property of the organizer and may, if desired, be awarded to a new winner through a new draw.

The draw will also be announced via our various social networks, while preserving the winner's identity.

Article 7: Prize Award

The winner undertakes to accept the prize as offered without any possibility of exchange, particularly against other goods or services of any kind whatsoever, nor transfer of the benefit to a third party.

"The Organizer" reserves the right, in the event of an unforeseen event beyond its control, particularly related to its suppliers or unpredictable circumstances, to replace the announced prize with a prize of equivalent value. The winner will be informed of any changes.

Article 8: Use of participants' personal data

Participants' information is recorded and used by "The Organizer" to remember their participation in the contest and to enable the prize to be awarded.

The personal data processed is the registration data necessary for the smooth running of the game.

For legitimate reasons, participants may object to the processing of their personal data communicated as part of this game. They also have a right to object to their use for commercial prospecting purposes, outside of participation in this contest, which they can exercise from the moment they register their participation by writing to "The Organizer" whose address is mentioned in Article 1.

In accordance with the Data Protection Act in its latest version, as well as Regulation No. 2016/679 of the European Parliament and Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), the participant may exercise their right to access, rectify, erase data, restrict processing, their right to data portability, their right to object, and their right to withdraw their consent by writing to "The Organizer" whose address is mentioned in Article 1.

Article 9: Assignment of image rights of the Participant(s)

By the mere fact of participating in the Contest, each Participant authorizes the organizer to use their first name, last name, as well as the indication of their city and department of residence, in any promotional event, on the website www.lacour-avocat.fr and all social networks of the CORPOMARKET company (LinkedIn, Facebook, Twitter, Instagram, TikTok, SnapChat, Twitch), and on any affiliated site or medium, without this use being able to open any rights or remuneration, other than the prize offered for this operation.

Participation in this operation implies the authorization for the Organizer to broadcast the image of participants, if they are declared winners, to reproduce and exploit their participations, their names and their images on all media (website www.just-scrape-it.com; all social networks of the organizer (LinkedIn, Facebook, Twitter, Instagram, TikTok, SnapChat, Twitch); print media; radio; television; cinema; events; etc.) for promotional purposes of the operation, within thirty-six (36) months following it.

This exploitation will not give rise to any consideration other than the benefit, for the winner, of the prize. It is granted free of charge by each Participant. Participants acknowledge that the use of their image does not in any way constitute an obligation for the Organizer, who may sovereignly decide whether or not to publish it within the aforementioned period.

Furthermore, Participants acknowledge that they will not have the right to review the selected photographs. Therefore, they will not be able to object to their dissemination, in accordance with the terms of the Rules. Participants acknowledge and accept the characteristics of the Instagram service, which allows and authorizes in certain circumstances the dissemination of content posted online by participants, and personal information concerning them. Participants also acknowledge that the terms of use of the Instagram service may vary, without the Organizer being held responsible in any way.

The Organizer cannot be held responsible in this respect in any way whatsoever.

Article 10: Game Rules

It can be sent free of charge to anyone who requests it from "The Organizer."

"The Organizer" reserves the right to extend, shorten, modify or cancel the game at any time, particularly in case of force majeure, without any compensation being claimed by the participants.

Article 11: Industrial and Intellectual Property

The reproduction, representation or exploitation of all or part of the elements making up the game, including these rules, is strictly prohibited.

All trademarks, logos, texts, images, videos and other distinctive signs reproduced on the site, as well as on sites accessible through hypertext links, are the exclusive property of their owners and are protected as such by the provisions of the Intellectual Property Code worldwide. Their unauthorized reproduction constitutes an infringement punishable by criminal penalties.

Any unauthorized reproduction, total or partial, of these trademarks, logos and signs constitutes an infringement punishable by criminal penalties.

Participation in this game implies full and complete acceptance of these rules by the participants.

Article 12: Liability

The liability of "The Organizer" cannot be invoked in the event of force majeure or an unforeseen event beyond its control.

"The Organizer" cannot be held responsible for delays, losses, thefts, damage to mail, or illegibility of stamps due to postal services. Nor can it be held responsible, and no recourse can be made against it, in the event of events constituting force majeure (strikes, bad weather, etc.) that partially or totally prevent participants from participating in the game and/or the winner from benefiting from their prize.

"The Organizer" and its service providers and partners cannot under any circumstances be held responsible for any incidents that may occur in the use of the prize by the beneficiary or their guests once the winner has taken possession of it.

Similarly, "The Organizer," as well as its service providers and partners, cannot be held responsible for the loss or theft of the prize by the beneficiary once the winner has taken possession of it. Any additional cost necessary to take possession of the prize is entirely the responsibility of the winner, without the latter being able to claim any compensation from "The Organizer," nor from the service providers or partners.

Article 13: Organization - Acceptance of Regulations - Disputes & Claims

These rules are governed by French law.

Participation in the contest (or the "Operation") implies full and complete acceptance of the Regulations.

In particular, the sole act of participating in this game implies the pure and simple, unreserved acceptance of the Regulations by the Participant.

"The Organizer" reserves the right to make a final decision on any difficulty that may arise concerning the interpretation or application of these regulations, it being understood that no dispute will be admitted, particularly concerning the terms of the game, the results, the prizes or their reception, one month after the end of the game. Except in the case of manifest errors, it is agreed that the information resulting from "The Organizer's" game systems constitutes proof in any dispute concerning connection elements and the computerized processing of said information relating to the game.

Any claim must be submitted within one month following the end date of the game to "The Organizer". After this date, no claim will be accepted.

Article 14: Proof Convention

By express agreement between the participant and "The Organizer", "The Organizer's" computer systems and files shall be the sole proof.

The computerized records, kept in "The Organizer's" computer systems, under reasonable conditions of security and reliability, are considered as proof of the relationships and communications between "The Organizer" and the participant.

It is therefore agreed that, save for manifest error, "The Organizer" may rely, particularly for the purposes of proving any act, fact or omission, on programs, data, files, recordings, operations and other elements (such as tracking reports or other statements) of a computer or electronic nature, format or medium, established, received or kept directly or indirectly by "The Organizer", particularly in its computer systems.

The elements considered thus constitute proof and, if produced as evidence by "The Organizer" in any contentious or other proceedings, they shall be admissible, valid and enforceable between the parties in the same manner, under the same conditions and with the same probative force as any document that would be established, received or kept in writing.

Operations of any kind carried out using the identifier and code assigned to a participant, following registration, are irrebuttably presumed to have been carried out under the responsibility of the participant.
